Common Law Marriage: A Legal Research Guide

The Texas State Law Library reference librarians created legal research guides for specific areas of the law. These guides contain resources that can help you research a legal issue.

The library regularly receives inquiries about common law marriage, also known as marriage without formalities or informal marriage. Within this guide, the three required elements to establish a common law marriage are highlighted as well as a link to the law that sets forth this requirement: Texas Family Code § 2.041. A “plain English” section links to resources that provide additional information on common law marriages in Texas. Researchers will also find titles available in the library’s collection that discuss common law marriage.
