Criminal proceedings do not have the same discovery rights that are available in civil cases. The Introduction notes that there was no right at all until “a modest version of Rule 16 of the Federal Rules of Criminal Procedure was first adopted in 1964.” FRCP Rule 16 has expanded and now provides for a more reciprocal discovery process.
